a) will notify the Complainant in writing that the Commission has received the <br />� complaint and will give the Complainant a copy of these procedures; and <br />b) will notify the Respondent in writing of the complaint and will give the Respondent a <br />copy of these procedures and a copy of the complaint. <br />2. The Commission will give both the Complainant and Respondent a copy o£ <br />a) any recommendation the Commission makes to the City Council concerning the <br />complaint; and <br />b) any supporting reasons the Commission gives to the Council to explain the <br />commission's recommendation. <br />B. The Commission's first decision--whether to go forward with the complaint <br />1. As soon as possible, but in any event within fourteen (14) calendar days after <br />receiving a complaint, the Commission will meet to consider: <br />a) whether the Respondent or Respondents named in the complaint are among the <br />officials the Corn-mission has the responsibility to investigate; <br />b) whether the behavior described in the complaint would, if true, be a violation of <br />the Code of Ethics; and <br />c) whether the complaint itself ineets the requirements of Section III of these <br />procedures. <br />The Commission will not �smiss a complaint for being va_gue or lacking specifics <br />without first explaining its concern to the Complainant, and asking the Complainant to <br />clarify the complain� Otherwise the Commission will ordinarily make the decision <br />based on the written complaint and will not receive oral testimony or other information <br />from the Complainant or Respondent. The Commission meeting is, however, open to the <br />public, including the Complainant and Respondent. <br />2. If the answer to one or more of these questions is "no" the Commission will recommend <br />that the City Council dismiss the complaint and will explain, in writing, its reasons for <br />the recommendation. The Commission will send or give both the Complainant and <br />Respondent a copy of the Commission's recommendations and reasons. Through one or <br />more of its members, the Commission will present its recommendation and reasons at a <br />Council meeting. <br />
