Resolution No. 8��)3 <br />Section 5. Handlin� �llleeed Violations of Code of Ethics. <br />E�i1��C 1 <br />A. An Ethics Commission is hereby established. The Commission shall be composed of three <br />individuals. two of whom shall be residents of the City and the third sha11 be a nonresident. <br />Initial appointments sha11 be for terms of one. t�i•o, and three years respectively. Thereafter. <br />appointments shall be for three year terms. The City Council sha11 appoint a chairperson and <br />secretary from the Commission membership. <br />Allegations of violations of this code against public officials. except employees ���ho are <br />subordinate to the City Manager. shall be referred to the Ethics Commission for <br />investigation. Allegations which may constitute a violation of a federal. state. or local statute <br />sha11 be referred to the appropriate criminal authority. <br />Results of the investigation ot�the Ethics Commission shall be reported to the City Council <br />along with the Commission's recommendation for disposition. Thereafter. the City Council <br />shall take appropriate action which ma�� include censure ol a Council Member. discipline o�� <br />City Manager. or no action. <br />The Commission shall conduct an organizational meeting during January or each �'�;ac, and <br />thereafter meet only at the request of the City Council or City Manager. <br />B. Allegations against public officials who are subordinate to the City Manager including the <br />Fire Chief and Assistant Fire Chief. sha11 be handled by the City Manager. The City <br />Manager may take appropriate disciplinary action against employees violating this code. <br />Section 6. Disclosure of Financial Interests. <br />Not later than ninety (90) days after the date of approval of this code. each public official of the City <br />shall file as a public record, in the oftice of the City Manager. a statement containing the following: <br />A list naming all business enterprises known by the public official to be licensed by or to be <br />doing business with the City in which the public official or any member of the public <br />official's immediate family is connected as an employee. officer. owner. investor. creditor <br />of. director. trustee, partner. advisor. or consultant: and <br />?. A list of the public officials and members of the public officials' immediate family's interests <br />in real properiy located in the City or which may be competing with the interests of the City- <br />located elsewhere. other than property occupied as a personal residence. <br />Each person who enters upon duty after the date of this code in an office or position as to �,1-hich a <br />statement is required by this code shall fi(e such a statement on forms to be provided by the Cit�� not <br />less than thiriy (30) days after the date of his,'lter entrance on duty-. <br />� <br />
