City Council Minutes —1 1/26/O1 <br />Copy Page 4 <br />Commission complaint proceedings. Pease responded regarding the <br />applicable provisions of the Ethics Resolution; Ethics Commissioner <br />Thomas Ring responded that he believed a clear and convincing <br />standard of proof should apply to ethics complaints. Klausing <br />reviewed each allegation of the ethics complaint. Klausing asked <br />about Section 3 C of the Ethics Resolution. Klausing summarized <br />his analysis of how one determines whether a violation of Section 3 <br />C has occurred. Goedeke asked how this part of the investigation, <br />involving campaign contributions, was conducted. Klausing asked <br />about the timing of the campaign contributions and the subsequent <br />lobbying activity. Goedeke reviewed his concerns about the overall <br />situation. All three Council Members thanked Commission Chair <br />Pease and the Ethics Commissioners. <br />Klausing moved, Goedeke seconded, to accept and approve the <br />Ethics Commission recommendation to dismiss the March 26, 2001 <br />Ethics Complaint of Richard Lambert against Mayor John <br />Kysylyczyn. <br />Discussion ensued among the <br />Ayes: Goedeke, Klausing, <br />Kysylyczyn and Maschka. <br />three Council Members. Roll Ca11, <br />and Mastel. Nays: none. Recused: <br />Kysylyczyn thanked the Ethics Commission for its efforts, remarked <br />about the nature and cost of this Ethics Commission investigation, <br />remarked about the nature of political campaigns and campaign <br />contributions, about lobbying activities for the City, and future <br />evaluation of the Ethics Resolution and ethics complaint process. <br />B. Approval of Minutes <br />B-1 Mastel moved, Maschka seconded, that the minutes of the special Minutes <br />joint work session with the Parks and Recreation Commission of <br />November 13, 2001 be approved. Roll Call, Ayes: Maschka, <br />Mastel, Goedeke, Klausing and Kysylyczyn. Nays: None. <br />B-2 Mastel moved, Maschka seconded, that the minutes of the regular Minutes <br />meeting of November 13, 2001 be approved. Roll Ca11, Ayes: <br />Maschka, Mastel, Goedeke, Klausing and Kysylyczyn. Nays: <br />None. <br />C. Consent Agenda Consent Agenda <br />Maschka moved, Mastel seconded, that items C- 1-C 10 be approved, <br />Roll Call, Ayes: Maschka, Mastel, Goedeke, Klausing and <br />Kysylyczyn. Nays: None. <br />
