3.0 Staff Recommendation <br />3.1 The Codes allow existing conditions to remain if the conditions complied with code <br />requirements at the time of installation which is the case in this situation. The only <br />instance in which newer code requirements can be enforced is when a substantial <br />hazard to life is present. <br />3.2 The facility has been inspected by the State Fire Marshal Office numerous times <br />previously> including an inspection by the Inspector now requiring the correction <br />(who had noted the spacing of these railings at nine inches and documented the <br />acceptance of the spacing). <br />3,3 The Fire Marshal and Building Codes staff recommend approval. <br />4.0 Suggested City Council Action <br />4.1 By motion> and based on the findings outlined in the City Fire Marshal's letter of <br />November 26, 2001, the City Council hereby forward to the State Fire Marshal a <br />recommendation to grant the variance request for retention of the existing stair <br />railing gaps of nine inches in the Radisson Hotel> Roseville> 2540 Cleveland Avenue. <br />Attachment; Letter of request from Dave S, Walia, Project Manager, Radisson Hotel Roseville <br />Prepared by, John Loftus, Fire Marshal <br />cc: Don Munson, Permits Coordinator <br />RCA-Radisson Hotel (12.11.01) Page 2 of 2 <br />
