1�i <br />.... <br />November 26, 2001 <br />Mayor and City Council <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, Minnesota 55113 <br />Council and Mayor: <br />Attached is a letter from Mr. Dave Walia, Project Manager from the Radisson Hotel located at 2540 <br />Cleveland Avenue North. Mr. Wfilia is requesting a variance from_a��corrective order issued by the State <br />Fire Marshal office. The corrective order requires the facility to reduce the spacing, between the stair <br />railings, from nine inches to four inches. Pursuant to Minnesota Statute 299F.011 subd. 5, the variance <br />request cannot be acted upon, by the State Fire Marshal, until the local governing body has acted upon <br />it. The Council may take one of three actions regarding this matter, recommend granting the variance <br />request, recommend denying the variance request, or defer the request to the State Fire Marshal with <br />no recommendation. <br />I visited the site to view the situation and to verify the violation. The stairs in question are in the section <br />of the building that our records indicate was constructed in the early 1970's. This is also approximately <br />the time at which the State Fire Marshal Office began inspecting Hotels on a three-year cycle. After <br />researching the past Fire Code and Building Code requirements, I found that The Building Code in use <br />at the time allowed for nine inch spacing on stair railings. <br />The present day codes require a four-inch spacing. However, the codes also allow existing conditions <br />to remain if the conditions complied with code requirements at the time of installation. The only instance <br />in which newer code requirements can be enforced is when a substantial hazard to life is present. This <br />facility has been inspected, by the State Fire Marshal Office, numerous times by various Deputy State <br />Fire Marshal Inspectors, including the Inspector requiring the corrections, with no corrective orders <br />regarding these railings.
