Regular City Council Minutes — 09/30/02 <br />DRAFT Minutes - Page 15 <br />Councilmember Schroeder spoke in favor of removal of <br />the three monuments to avoid future liability to the City. <br />Mayor Kysylyczyn asked City Attorney Jamnik to clarify <br />the City's standing ordinance addressing sight angles and <br />construction of obstructions. <br />City Attorney Jamnik concurred with Mayor Kysylyczyn's <br />argument that the City could bring charges against a <br />resident for violating the standing ordinance; further <br />stating that while it may be viewed at a double standard <br />for the City to have items in the sight line, installation of <br />utilitarian items or newspaper boxes were often weighed <br />against standards, and may be subject to individual site <br />evaluations. <br />Mayor Kysylyczyn spoke to the overall policy question: <br />Why were these pillars installed violating standing City <br />ordinance, when they're not infrastructure items, and why <br />should the City be policed any differently than residents? <br />Councilmember Schroeder concurred. <br />Councilmember Kough concurred, but questioned whether <br />all three needed to be removed; and whether the railing <br />also constituted a problem. <br />Mayor Kysylyczyn spoke to safety issues with senior <br />citizens living in housing units in the area. <br />Further discussion included relocation costs; how much of <br />the column materials would be salvageable; and the need <br />to replace pavers or till in where the monuments were <br />located to create a smooth surface. <br />Schroeder moved, Kysylyczyn seconded, directing staff to <br />remove the three (3) monuments on Larpenteur Avenue; <br />Kysylyczyn offered a friendly amendment to include <br />wording that the removed monuments be saved and reused <br />at the discretion of the Parks Commission; <br />
