Regular City Council Minutes — 09/30/02
DRAFT Minutes - Page 15
Councilmember Schroeder spoke in favor of removal of
the three monuments to avoid future liability to the City.
Mayor Kysylyczyn asked City Attorney Jamnik to clarify
the City's standing ordinance addressing sight angles and
construction of obstructions.
City Attorney Jamnik concurred with Mayor Kysylyczyn's
argument that the City could bring charges against a
resident for violating the standing ordinance; further
stating that while it may be viewed at a double standard
for the City to have items in the sight line, installation of
utilitarian items or newspaper boxes were often weighed
against standards, and may be subject to individual site
evaluations.
Mayor Kysylyczyn spoke to the overall policy question:
Why were these pillars installed violating standing City
ordinance, when they're not infrastructure items, and why
should the City be policed any differently than residents?
Councilmember Schroeder concurred.
Councilmember Kough concurred, but questioned whether
all three needed to be removed; and whether the railing
also constituted a problem.
Mayor Kysylyczyn spoke to safety issues with senior
citizens living in housing units in the area.
Further discussion included relocation costs; how much of
the column materials would be salvageable; and the need
to replace pavers or till in where the monuments were
located to create a smooth surface.
Schroeder moved, Kysylyczyn seconded, directing staff to
remove the three (3) monuments on Larpenteur Avenue;
Kysylyczyn offered a friendly amendment to include
wording that the removed monuments be saved and reused
at the discretion of the Parks Commission;
