<br />WHEREAS, The Village of Roseville has been unable to <br />negotiate for the purpose of purchasing said land; and <br /> <br />WHEREAS, Under the Statutes of the State of Minnesota, <br />the Village has the power to take and acquire such property by <br />power of eminent domain; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL <br />FOR THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: <br /> <br />The Village Council hereby deems it necessary and <br />convenient that the property described below be acquired by <br />the Village of Roseville in fee simple for the purpose of <br />ponding and storage of surface waters, all of said property <br />being situated in the Village of Roseville, County of Ramsey, <br />and State of Minnesota, to-wit: <br /> <br />Except 50 feet by 67 feet more or less for sewer <br />lift station as in Doc. 1535987, part of Lot 12, <br />A. K. Barnum's Garden Lots, Northeasterly of <br />following: <br /> <br />Beginning at the East Corner of Lot 12; thence <br />Southwesterly on the Southeasterly line of said <br />Lot a distance of 267.5 feet; thence right <br />93048' a distance of 325 feet, said point being <br />the Southeasterly right-of-way line of Heinel <br />Drive; thence Northeasterly along said right-of- <br />way line a distance of 298 feet more or less to <br />the Northeasterly line of Lot 12, thence Southeasterly <br />along said Northeasterly line 330 feet more or less <br />to the point of beginning, and there terminating, <br />according to the plat thereof, on file and of record <br />in the office of the Register of Deeds, Ramsey County, <br />Minnesota. <br /> <br />The Village Council hereby deems it necessary and convenient <br />that the Village acquire permanent road and underground utility <br />easements across the property described below, all of said <br />property being situated in the Village of Roseville, County <br />of Ramsey and State of Minnesota, to-wit: <br />
