<br />MR. POPOVICH: I might say the s"':atu+:e, Mr. Anderson, says <br />the ci~y should send notices +0 that list maintained in the <br />County Auditor's Office. The statute does go further and says <br />that failure to have sent notice or any defect does not vi~:iat:e <br />the proceedings because in addition there's public notice in <br />Yvur official newspaper which was done as well. I know Mr. Dorso <br />raised that question that. he didn't get: notice on one part. <br />Occasionally these things do occur in the mail where a notice <br />doesn't get out, but that will not wreck +he proceedings and <br />require you to start over. <br /> <br />COUNCILMAN ANDERSON: As I understand the proceeding to- <br />night, the Council cannot enlarge that area but we could de- <br />crease it. <br /> <br />MR. POPOVICH: Once you describe an area, that's the area <br />you're with. You can reduce but can't enlarge unless you start: <br />over and that's why the engineering department usually will fit <br />these into other previous improvement.s or o'l-hers that will be <br />projected for the future so eventually every piece of property <br />will be in some improvement or storm sewer at. some particular <br />point. in time depending on the need, but if, for example, the <br />Council felt you wanted to enlarge the improvement and not wait <br />for a subsequent one, we'd have to start allover again. <br /> <br />MAYOR DEMOS: Is there anyone else? <br /> <br />MR. N. H. Shepard, 2965 Cleveland: If they can't get. more <br />flowage out. of this, what's the use of going through the whole <br />procedure? <br /> <br />MAYOR DEMOS: r1e're not putting all the flowage in that one <br />pipe - we're putting some in the holding pond. <br /> <br />MR.
