<br />-3- <br /> <br />Bill ift3. <br /> <br />Section 1. <br /> <br />Amends Laws 1974, Chapter 435 (Ramsey County Code) Section 3.02. <br />Subdivision 2(b) repeals provision requiring the members of the Civil <br />Service Commission to file an oath upon taking office. This provision is <br />re4undant as the matter of oaths is already covered by state-wide statute. <br />Subdivision 3 deletes provision relating to the county contracting <br />for service with the City Civil Service Bureau. Joint powers legislation <br />makes language unnecessary. <br />Subdivision 4(a)(5) allows the use of a number other than three in <br />setting an eligible register. The number used will be determined by the <br />Civil Service Commission. For example the State of Minnesota uses 10 as <br />the number for setting an eligible list. Increasing the number of eligi- <br />bles provides management with a broader base for determining ~lhich pros- <br />pective employees are most qualified. <br />Subdi~sion 4(a)(6) provides that the length of a probationary <br />period after appointment or promotion may range from a minimum of sb: <br />months to a maximum of one year. <br />Subdi~ision 4(a) (8) expands transfer provisions of the civil service <br />regulations to in~lude transfers from another merit system. <br />. Subdivision 4(a) (9) eliminates the requirement that "whenever prac- <br />ticable" vacancies ,-lould be filled by promotion. Among other things, <br />elimination of this language would assist the development of a functional <br />attrition syst~. <br />Subdivision 6(a.) adds the Nursing Home and Welfare Department em- <br />ployees under the coda classification of serviCe definitions. <br /> <br />Subdivision 6(b) (2) places the County Assessor in the unclassified <br />service of the County, ma.l<ing the Assessor a will and pleasure appoint. <br />ment of the Board of County Commissioners. This does not reduce in any <br />way the qualifications necessary to be considered for appointment. <br />Subdivision 6 (b)(7) places election judges and election clerks in <br />the unclassified service and deletes archaic language relating to persons <br />employed to maint:ain or operate tax forfeit land. The county no longer <br />needs this provision. <br />Subdivision 6(b)(13) places the chief executive officer of St. Paul- <br />Ramsey Hospital and th:ree principal assistants in the unclassified ser- <br />vice 0 f the county. <br />Subdivision 6(c)(l) clarifies definition of classified service by <br />deleting unnecessary language. <br />Subdivision 6(c)(2) clarifies the definition of positions in the <br />graded division. <br />SUbdivision 6(c)(3)(A) deletes unnecessary language relating to the <br />transfer of Welfare Department employees from the Merit System to the <br />County Civil Service System.. <br />Subdivision 7(b) further clarifies language relating to the transfer <br />of Welfare employees from Merit System to County Civil Service System. <br />Subdivision 17 deletes language prohibiting the County from hiring <br />aliens. This provision is unconstitutional (see Sugarman v.
