MR. KATH: Right from here. Right here from here to here
is the piece that I have. The water runs up so close to this
I can't build a home on to it. I don't feel that I'm really
not over-joyous about paying for sewer or road because I can't
use it for any benefit so you can understand I'm not really
standing here jumping for joy. And I'm sure that a lot of
you people on the Council can understand the hardship I have
already gone through on this piece of property.

MAYOR DEMOS: You're also saying the DNR won't let you
fill.

MR. KATH: What good is it? I got to get an answer. If
I could try to capture some of my bucks back out of this I
wouldn't feel bad about it, but I do feel I'm not going to get
any money out of it, and money, I guess, is the name of the
game, and it really has put a tremendous hardship on me now.
Let me try to point out - I did have this thing sold at one
time. It didn't go through and I won't go through that, but
I have been paying taxes on this piece of property for five
years. I have a $90,000 lawsuit pending on it besides that.

MAYOR DEMOS: We're not responsible for that.

MR. KATH: I think partially because somebody refused to
put their name on the DNR (ina11dible) on this, but regardless
of thatf I rose above this and it was a hardship, but I have
also been putting the taxes on to it, and if you can show me
how I can capture my dollars out of this I will go along
because I'm 100% for streets and curbs and gutters and the
whole works.

MR. HONCHELL: How much depth of lot do you feel you'd
need?

rm. KATH: I don't know, but I forgot who it was that was
all in to it, but Steve North was in it and we come back in
and I was really excited about this because, yes, maybe we
could - you can go back into a lake and own as much of a lake
as you want, but you can only build so much, and when I got
out there and I thought, gee, I'm gonna get some of my tax
bucks back, and the guy said, I don't want them. I couldn't
even choke down my supper that night.

MR. HONCHELL: Looking at the area, it looks like you
have 90 feet by 90 feet.

MR. KATIl: They come out 92 foot frontage for four lots,
but there isn't enough after they went back in to step it out -
he s aid I'd be ashamed .to go to the Ci ty Counci 1 and ask for
a permit because we will have to infringe on the water, and
I said, leave me out of it.

8
