Discussion ensued regarding the incident. City Manager Malinen said he provided a complaint <br />form to use if he chose, in accordance with the City's normal procedure. <br />Chair Delmore suggested that she contact the complainant to advise him of tonight's discussion, <br />as well as the existence of the surveillance tape. <br />Commissioner Singleton noted that with a complaint process in place, it appeared that the <br />complainant was seeking to go around that normal process. <br />Commissioner McKenzie said based on her past experience on the HRC in addition to her work <br />in the legal field, she preferred to follow the process and recommended that the complainant file <br />a complaint and submit that prior to further HRC involvement or discussion. <br />City Manager Malinen questioned whether the HRC was the proper forum for the complainant, <br />given that a grievance process is in place. City Manager Malinen assured Commissioners the <br />Police Chief, the Police Department and he took formal complaints seriously. Malinen said he <br />was unsure why the complainant was reluctant to file a written complaint if he was not satisfied <br />with discussions. <br />Commissioner McGehee suggested that Chair Delmore contact the complainant to advise him of <br />tonight's HRC discussion, and to encourage him to fill out a formal complaint form, and in <br />addition, to provide the HRC in writing his point of view and review of the situation, and his <br />preferred outcome of this situation. Commissioner McGehee opined that the complainant didn't <br />have to attend an HRC meeting; but suggested that Chair Delmore could request the video tape <br />for the HRC to review at an upcoming meeting. <br />Commissioner McGehee opined that it was recourse if people didn't trust the process. <br />City Manager Malinen opined that, while a complaint process was already in place, the HRC was <br />promoting that one individual who may not like that process, a complainant could circumvent the <br />process, serving to undermine the Police Department and a process by which citizens would get <br />problems addressed. <br />Chair Delmore took issue with City Manager Malinen's interpretation of the number of citizen <br />complaints being heard. <br />Commissioner Crump opined that he would prefer to see a written complaint; and if he has an <br />issue, the complainant follow the process by submitting the complaint to the Police Chief, with a <br />copy to City Manager Malinen, and possibly the HRC. Commissioner Crump expressed concern <br />that, if there was a danger of potential litigation, the HRC needed to remain moot until that <br />litigation was resolve. <br />Commissioner McKenzie said when there was a complaint with the Police Department with an <br />official complaint and investigation in process, the Roseville HRC could not do anything, <br />reminding Commissioners that they were an advisory commission to the City Council. <br />Commissioner McKenzie noted there used to be a mediation team that a majority of Minnesota <br />
