that the curb and gutter is necessary. Therefore, I am opposed
to it.

MR. JOHN DEVINY, 2814 Merill: I was the walker, if you will,
on this petition. I'm very impressed tonight by the discussion
I've heard and I'm very pleased to see those people who have put
their views across, both pro and con. During my walks around
the neighborhood I had a number of chats and some lengthy ones
with both people who weren't particularly in favor and those who
were in favor. I got to see a little more polarization on the
issue, I suppose which is natural as it comes down to the vote.
I am concerned about one thing, and if I may, Mayor - Mr. Andre,
you had mentioned some figures which are not consistent with
those which I have. I'm wondering if there have been some names
possibly which were not in order. There were 20 signatures out
of 37 property owners, everyone of which was personally contacted
by myself. Those 20 did sign the petition. Is your figure
different than that?

MAYOR DEMOS: Our percentages go for assessable feet.

MR. JOHN DEVINY: I'm talking about numbers of people.
There were 20 signators.

COUNCILMAN FRANKE: On the petition for or against?

MR. JOHN DEVINY: On the petition for. There were 20 out
of 37 possible signators.

MR. ANDRE: I have only 18 (inaudible).

MR. JOHN DEVINY:

There appear to be some

WOMAN FROM AUDIENCE: I can possibly be of some help there.
I recently - the day after my grandfather signed, I bought the
house from him. So that might be some variance (inaudible).

MR. ANDRE: I'm sorry, I think there are 20 here.

MR. JOHN DEVINY: I think it's important for the Council to
keep~the silent majority in mind during its deliberations. Jim
Foley mentioned the question of numbers of signers on the peti-
tion and the vote. I hope that I have made that clear to people
that we needed in excess of 35% (inaudible) front footage people
so that we could get the situation passed to a 3/2 vote. Four
people would be required if ib was less than 35%. So there was
that relationship between the number of people and what was
required to pass. I thought I had made that clear to people. Now,
Jim has asked to have his name - had indicated that he is no~ in
favor. That would reduce that 20 to 19. That, members of the
Council, is still in excess of 50% of the individual property
owners along Merrill Street, and as such, constitutes a majority.
I also hope that anybody that signed the petition before and has
changed their mind - as I tried to indicate to them, they should
take this opportunity to do so and be heard. If not, we do still
stand at more than 50% in favor.

11
