MR. ANDRE: Excuse me, Jack. That 18 I mentioned - that was
the petition in opposition to it. (Inaudible). That petition
reflects three original petitioners that have signed this petition
in opposition.

MR. JOHN DEVINY: So we're kind of split.

MAYOR DEMOS: It's pretty close.

MR. JOHN DEVINY: I think that's good. We made every effort
in discussing this with people to point out this possibility. I
think there was no question among the people I talked to that
functionally, the street is not in good condition. Marsh Anderson,
I think, addressed it very finely, and I won't try to repeat many
of the things he said, the reasons that we were interested in
having an improvement made. I think that's the important thing
to keep in mind. There was a desire for an improvement. It was
not a desire to have a 32 foot wide street with 15 beautiful trees
- which I am quite sensitive to also, and I see that one of mine
is earmarked, which I personally planted, for possible problems.
I would be very comfortable with a 29 foot street. I would be
very comfortable with a 25 foot street, just the way it is. I
could care less about the width of the street. That seems to be
an issue that was not addressed originally and is open to some
consideration. So the matter of functionality (inaudible) that as
a street, per se, much is left to be desired. I am very sensitive
to the question of the environment and I share those views quite
a bit. I cannot, in the wildest parts of my imagination, believe
that an improvement of the street is going to increase the speed
down the street, as pointed out along Judith. That seems to me to
be much faster and in worse condition than ours is. The only
other thing that I think comes to mind is - we were discussing
this at the dinner table tonight and my II year old daughter, who
was listening to my wife and I, I saw her very intently - I said,
what do you think about this whole thing? From a child's point of
view? She put it so simply. She said dad, our street is just
plain ugly. Why can't it look at least as nice as Merrill
(inaudible) County Road C-2. Maybe that's too simplistic, but
I think, from an aesthetic point of view, I certainly share that
observation. I think we have had a good amount of support. I
suspect that if we can salvage most, if not all of the trees, that
that would certainly be reflected more favorably on the part of
those who have concerns. I would like to have that as the major
consideration - that it be no more than 29 feet and that we save
every possible tree in the area. I think we still stand with
a substantial vote in favor of' an improvement on the street, and
I hope the Council will act accordingly. ~hank you.

MR. ANDRE: (Changed Tape) . 3/5 vote in this case. If
it is less than 35%, then it requires a 4/5 vote. That is the
only - this is a legal reference and it does not really relate to
the number of signatures and this type of thing. It relates to
what is required, as far as a vote, legally.

MAYOR DEMOS: Anyone else from Merrill Street?

12
