MAN FROM AUDIENCE: 37 - One lot is vacant.

MR. ANDRE: The percentage relates to the percentage of
(inaudible) front footage throughout the whole project. My com-
ment before related to whether or not we counted (inaudible).

MR. ROBERT REED: Right - the 35%, I understand that, in
order that you must hold a hearing - but I'm not concerned with
that. I'm concerned about percentages, particularly if they are
influential on your vote. As I said in my earlier comments - we
did not sign either petition. We are just strongly opposed at
this point. I will lend my hand to the petition against if that
will effect the kind of result that I definitely want. Trish Lind
spoke to the same effect. She's also opposed and did not sign
either petition. If the percentages here are crucial, I would
like to know that before the Council votes. One other matter -
the term was used by one of the gentlemen up here speaking for
the opposition - the term "improvement". I guess I would like to
say that I don't believe that either side should have a corner
on that term. To assume that gutters and the rest that goes with
that improves - aesthetically or in other ways - assumes a certain
value which cannot be stated as objectively - merely subjective.
I'm uncomfortable with the use of that word. I wish they would
just say gutters.or curbs or whatever. Leave that word "improve-
ment" off. I think it would improve it, so to speak, to leave
it as it is. .

MAYOR DEMOS: Each of us make our decision in our own manner.
This is on any subject that the City (inaudible). We probably
come to our decisions in different ways. In other words, we do
not set up and say that each of us is going to vote on this
factor, this factor, this factor. I can only tell you how I vote.
I cannot tell you how the other four vote. You may not think
well of me when I tell you how I vote. If someone has signed
both petitions, I don't count them in my mind at all. You may
think that strange, but that has been the way I have made my
decisions. That person is a vacillator, they are influenced in
one direction one time and one direction another. In other words,
I have to vote on those who are hard and fast in one way or the .
other. I'm only telling you how I vote. The percentages are
for the purpose of bringing it to a vote, bringing it to a
hearing. Also, those percentages are ~ that they talk about -
are by assessable feet, not numbers of people or pieces of
property. So consequently we're considering two different things
there. It's only right that we vote for people, not feet. At
least that's my opinion. Forg'ive me for saying what I did, Jim.

MR. JAMES FOLEY, 2717 Merrill: That's alright. I hear you
saying that you're listening to these people and you decide up
there right now. I've heard three or four in favor of it and I've
heard about a dozen against. So you're telling me that 75% in
this room are saying that they don't want it, so that I S probably
the way you're going to go.

MAYOR DEMOS: It's nine to two on pieces of property
(inaudible). I'll tell you what the count is right now.

IS
