Public Hearing to Consider Amending City Code, Chapter 302, to Allow for <br /> a Brewery and Off-Sale Retailing Liquor License <br /> Finance Director Chris Miller provided a brief summary of this request, as de- <br /> tailed in the Request for Council Action(RCA) dated April 25, 2011. <br /> Mayor Roe clarified that the purpose of the proposed amendment to City Code, <br /> Chapter 302, and references to state statute was specific to the type of businesses <br /> addressed in state statute, stipulating the number of barrels manufactured annually <br /> and those sold off-sale. <br /> Mr. Miller summarized state statute, with 3500 barrels per year maximum produc- <br /> tion; with the City Code, as proposed, to parallel that statute; with this specific re- <br /> quest for a small production brewery, not to be confused with those recently in the <br /> news seeking changes in state legislation. At the request of Mayor Roe, Mr. Mil- <br /> ler further confirmed that production and sales would be limited to beer manufac- <br /> turing and packaging on site, in accordance with state statute. <br /> Councilmember McGehee questioned previous discussion of the sale of growlers <br /> at Granite City in Roseville, and how those sales differed from the request of Pour <br /> Decisions Brewing Company, LLC for a small production brewery to distribute <br /> products to retail locations. <br /> Mr. Miller advised that, under state statutes, there was a separate category and dif- <br /> ferent requirements for a restaurant operation, such as Granite City; noting that <br /> restaurants had the necessary state and city licenses to sell their product; but again <br /> clarified that this is a separate off-sale license request, a different situation and <br /> category completely. <br /> Councilmember McGehee questioned the consequences should state statute <br /> change. <br /> Mr. Miller advised that the City Code points to state statute provisions, and City <br /> Code would be changed as applicable should state statute change. <br /> Further discussion included limitations of off-sale sales on their site for retail for <br /> removal off-site to avoid the need for an on-sale license, with other business in- <br /> terests continuing as currently operating; and staff's rationale to not limit the <br /> number licenses for this type of off-sale retailing liquor license, based on their re- <br /> search of other communities and model ordinances. <br /> Mayor Roe opened the Public Hearing at 7:30 p.m. for the purpose of hearing <br /> public comment on possible amendment to City Code, Chapter 302, to allow for <br /> brewery and Off-Sale retailing liquor licenses <br /> Applicants, B.J.
